US special counsel appeals Trump’s secret documents case dismissal

Donald Trump applauded the case dismissal and urged the dropping of further criminal cases against him.
The United States Special Counsel, Jack Smith, has appealed a judge’s dismissal of a criminal case against former President Donald Trump for mishandling confidential government papers.

Smith filed the appeal with the Atlanta-based 11th US Court of Appeals on Wednesday, days after US District Judge Aileen Cannon dismissed the lawsuit in a big victory for the ex-president and 2024 Republican presidential hopeful.

On Monday, Cannon decided that Smith’s 2022 appointment violated the US Constitution because Congress did not authorize Attorney General Merrick Garland to nominate a special counsel with Smith’s power and independence.

Trump, who appointed Cannon to the bench in 2020, quickly hailed the decision and urged for the dismissal of other indictments against him.

“This dismissal of the Lawless Indictment in Florida should be just the first step, followed quickly by the dismissal of ALL the Witch Hunts,” he wrote on Truth.

The former Republican president faces three more criminal cases, two of which involve his efforts to overturn the 2020 election loss to President Joe Biden.

November’s US elections will pit Trump against Biden again.
