Tony’s Chocolonely Faces Lawsuit from Milka-Maker

Mondelez, the manufacturer of Milka chocolate, has taken legal action against Tony’s Chocolonely, alleging that the Dutch chocolate brand mimicked Milka’s distinctive purple packaging. Tony’s Chocolonely recently launched a campaign in Germany and Austria, unveiling four temporary wrappers inspired by well-known chocolate bars, including Milka, Kit Kat, Twix, and Ferrero Rocher. The campaign aimed to highlight child labor issues within the cocoa industry, particularly involving major suppliers.

Mondelez claims ownership of a color trademark for the purple used in Milka’s packaging and has initiated legal proceedings based on allegations of trademark infringement. While Tony’s Chocolonely has acknowledged the legal challenge, it has expressed its commitment to changing the packaging to comply with a legal injunction. The company plans to appeal the injunction, emphasizing its ongoing dedication to addressing cocoa industry challenges, particularly the exploitation and child labor prevalent in cocoa farms.

This legal dispute underscores broader challenges and ethical concerns within the chocolate industry, focusing on issues such as child labor and exploitation in cocoa production. Tony’s Chocolonely has a history of using unconventional methods to draw attention to industry challenges, with a previous campaign involving an intentionally empty window in its advent calendar to highlight inequality in the chocolate industry. Despite the company’s efforts to advocate for positive change, it has faced criticism for its unconventional approaches, such as upsetting parents with the empty window campaign.

The legal battle between Mondelez and Tony’s Chocolonely reflects the complexities and ethical considerations within the chocolate industry.
