The judge hearing Dominion Voting Systems’ case against Fox News said on Wednesday that he was sanctioning the network and would likely investigate if Fox’s legal team concealed information, the New York Times reported.
“Fox will do everything they can to make the person available, and it will be at a cost to Fox,” Delaware Superior Court Judge Eric Davis concluded in punishing Fox.
Fox didn’t reply to Reuters’ request for comment.
Dominion claims that Fox, owned by Fox Corp (FOXA.O), destroyed its business by knowingly airing false claims that its ballot-counting machines flipped the 2020 U.S. presidential election against Republican then-President Donald Trump, who lost to Democrat Joe Biden.
Dominion claims Fox exceeded the boundary between ethical journalism and ratings-driven coverage, which Fox rejects.
Opening arguments begin Monday, while jury selection begins Thursday.
