Biden Administration allows US trade tribunal’s ban on Apple Watch imports

The Biden Administration allows the US Trade Tribunal’s ban on Apple Watch imports. Masimo (MASI.O), a firm specializing in medical monitoring technology, filed a lawsuit against the decision of a government tribunal to prohibit imports of Apple (AAPL.O) watches. On Tuesday, the administration of Vice President Joe Biden of the United States of America decided not to veto the judgment.

Beginning on December 26, the United States International Trade Commission will forbid the importation and sale of Apple Watches that use patent-violating technology to read blood oxygen levels. Apple has already incorporated the pulse oximeter capability into its smartwatches, beginning with the Series 6 model, which will be released in 2020.

“After careful consultations, Ambassador Tai decided not to reverse the ITC’s determination and the ITC’s decision became final on December 26, 2023,” the organization stated in its final ruling.

An appeal against the prohibition can be filed with the United States Court of Appeals for the Federal Circuit by Apple.

According to Masimo, Apple has been accused of stealing its pulse oximetry technology and inserting it into the popular Apple Watch. Masimo also claims that Apple has hired away its personnel.

Masimo’s charges were brought before a jury in a federal court in California, but the trial was declared a mistrial in May. Apple has taken it upon itself to file a separate lawsuit against Masimo for patent infringement in a federal court located in Delaware. Apple has referred to Masimo’s legal activities as a “maneuver to clear a path” for its competing smart watch.
